2. Eligibility to Use Services

You must be at least 18 years old and capable of entering into binding agreements to use our Service. By using the Service, you represent that you meet these eligibility requirements.

3. Client Obligations

To ensure the success of any project or campaign, the client agrees to:

• • Provide accurate and timely information

• • Respond to approval requests, feedback, or resource needs in a timely manner

• • Adhere to payment schedules as outlined in their agreement

• • Not alter, interfere with, or duplicate work done by ClickFuelMarketing Agency without consultation

Delays in client communication or deliverables may impact project timelines and performance.

4. Service Guarantee

ClickFuelMarketing Agency is committed to delivering high-quality results. We offer a satisfaction guarantee on all eligible service packages:

• • If your service outcomes (as outlined in the agreement) are not met due to our execution, we will continue working at no additional cost until performance goals are achieved.

• • If, after multiple good-faith revisions, the goals are still unmet, we may issue a partial or full refund, subject to review.

This guarantee does not apply to delays or underperformance caused by:

• • Lack of client response or participation

• • Misuse or alteration of our work

• • External platform restrictions (e.g., Google/Facebook algorithm changes)

• • Third-party service failures

The guarantee terms will be defined in your service contract.

5. Payment Terms

Payment terms are outlined in your individual agreement. In general:

• • Invoices must be paid in full by the due date stated

• • Late payments may result in a pause in services or additional fees

• • Monthly or retainer-based services are billed on a recurring basis

Non-payment beyond 14 days of the due date may result in contract termination, collection actions, or withheld deliverables.

6. Intellectual Property

All intellectual property created by ClickFuelMarketing Agency during service delivery (including website designs, ad creatives, email templates, and custom copywriting) remains the property of ClickFuelMarketing until full payment is received.

Once payment is completed in full, rights to deliverables transfer to the client, unless otherwise stated in writing.

Pre-existing tools, templates, or proprietary frameworks used in the creation process remain the property of ClickFuelMarketing Agency and may not be copied or redistributed.

7. Links to Third-Party Websites

Our Service may contain links to third-party websites or services that are not owned or operated by ClickFuelMarketing Agency.

We are not responsible for the content, privacy practices, or policies of these websites. You acknowledge and agree that we are not liable for any loss or damage caused by your use of or reliance on third-party sites or content.

8. Termination of Services

ClickFuelMarketing Agency reserves the right to terminate or suspend access to any part of the Service at any time, with or without cause, and with or without notice.

Reasons for immediate termination include:

• • Harassment or inappropriate behaviour toward team members

• • Misuse of the service or tools

Upon termination, any outstanding payments remain due. Clients may also terminate their contract with 30 days’ written notice unless otherwise stated in the agreement.

9. Limitation of Liability

To the maximum extent permitted by law, ClickFuelMarketing Agency shall not be liable for any indirect, incidental, or consequential damages, including (but not limited to):

• • Lost profits or revenue

• • Business interruption

• • Loss of data

• • Platform-related suspensions (e.g., Facebook Ad Account bans)

Our total liability for any claim related to services shall not exceed the total amount paid by the client for those services.

This does not affect your rights under our Service Guarantee.

10. Disclaimer of Warranties

We do not guarantee specific sales numbers, website rankings, or ad performance unless explicitly stated in your agreement.

Marketing outcomes can be influenced by many factors, including market conditions, competition, and customer behaviour — all of which are outside our control. We do, however, guarantee that we will apply best practices, proven strategies, and measurable effort to help you succeed.

11. Changes to These Terms

We may update these Terms from time to time. If a change is material, we will provide notice via email or website announcement at least 30 days before changes take effect.

Your continued use of our Service after changes are made constitutes your acceptance of those changes.

12. Governing Law

These Terms are governed by the laws of the Province of Alberta, Canada. Any disputes arising out of these Terms shall be resolved in the courts located in Alberta.
